CONTRIBUTION AGREEMENT
OPENIB STACK FOR WINDOWS
TERMS AND CONDITIONS FOR SUBMISSION OF CONTRIBUTION
If you make a contribution of software or code to
an OpenIB Maintainer for proposed acceptance and inclusion in the OpenIB Stack
for Windows, you agree to the following terms and conditions. If you do not
agree, then you may not make a contribution, and your contribution cannot be
accepted. All submitted contributions are subject to these terms and
conditions.
-
All contributions must be made under the terms of a Berkeley Software
Distribution ("BSD") License. Contributions may not be made under the GNU
General Public License.
-
Contributor warrants and represents that his/her/its contribution has been
written exclusively by Contributor, or has been provided to Contributor under a
valid BSD license.
-
Contributions must be submitted with source code.
-
Contributor agrees not to assert any patents reading on its contribution
against any user of its contribution, if and to the extent the contribution is
accepted, included in, and used with the OpenIB Stack for Windows.
-
Contributor warrants and represents that, to the best of his/her/its knowledge,
the contribution does not contain or infringe the intellectual property of any
person or entity.
-
The Contributor warrants and represents that he/she/it has executed and abided
by the End User License Agreement ("EULA") for Microsoft Software dated March
31, 2005, for Windows Server 2003 Driver Development Kit, or its successor
agreement; that the submission of the contribution and its subsequent
distribution does not violate the terms of the EULA; and that the contribution
does not contain Sample Code or Redistributable Code, or any derivative work
thereof, within the meaning of the EULA.
-
Contributor agrees to indemnify, hold harmless, and defend OpenIB from any
claims or lawsuits, including attorneys' fees, arising from or relating to
Contributor's breach or alleged breach of these terms, conditions, warranties,
and representations.
-
Contributor, if an employee of an organization, and if the organization has an
interest in the contribution, warrants and represents that the organization has
authorized the contribution, and has agreed to be bound by all of the terms,
conditions, warranties, and representations set forth herein.
-
Submission of a contribution does not guarantee acceptance by the Maintainer or
by OpenIB. Maintainers and OpenIB each reserve the right and discretion to
decide whether to accept a contribution, to accept it with or subject to
conditions, or to reject it.
